Welcome to Catalina’s Linen.

These Terms & Conditions govern your use of www.catalinaslinen.com and any purchase made through our online store.

Catalina’s Linen is operated by Idea Groove (Pty) Ltd, registration number 2024/280792/07, registered in South Africa.

By accessing our website or placing an order with us, you agree to these Terms & Conditions.

1. Our Products

Catalina’s Linen offers baby and nursery linen, including fitted sheets and related products.

We take reasonable care to ensure that the photographs, colours, prints and finishes shown on our website represent our products as faithfully as possible. However, colours may appear slightly different depending on your screen, device settings and lighting conditions.

The placement of individual elements within printed fabrics may differ slightly from one product to another. These natural variations in print placement are not considered defects.

Reasonable manufacturing tolerances may also apply to stated product measurements.

2. Waterproof Products

Certain Catalina’s Linen products incorporate a waterproof protective layer.

The performance and lifespan of the waterproof layer depend on the product being washed, dried and cared for according to the applicable care instructions.

Damage resulting from incorrect washing, excessive heat, bleach, ironing of waterproof materials, cutting, puncturing, misuse or ordinary wear and tear will not ordinarily be regarded as a manufacturing defect.

3. Product Information

We make reasonable efforts to ensure that product descriptions, prices, dimensions and other information displayed on our website are accurate.

If we discover a material error relating to an order, we will contact you as soon as reasonably possible and offer an appropriate solution.

Furniture, toys, artwork, plants, decorations and other accessories shown in lifestyle photographs are for styling purposes only unless specifically stated as being included in the product listing.

4. Orders

By placing an order, you confirm that the information supplied by you is complete and accurate.

You are responsible for checking:

your selected product;
size;
design;
quantity;
delivery details; and
any personalisation information

before completing your order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

an item is unavailable;
an obvious pricing or listing error has occurred;
payment cannot be verified; or
fraudulent or unlawful activity is suspected.

If we cancel an order after receiving payment, the relevant amount paid will be refunded.

5. Prices and Payment

All prices are displayed in South African Rand (ZAR) unless another currency is expressly displayed.

International customers may see prices converted into another currency depending on the functionality available through our website or payment provider.

Delivery charges and any other applicable charges will be displayed before checkout where reasonably possible.

Payment must be made through one of the payment methods offered on our website.

Payments may be processed by third-party providers, including Shopify-supported payment services. Catalina’s Linen does not ordinarily store complete credit or debit card details.

We may amend product prices from time to time. A price change will not affect an order already accepted by us.

6. Product Availability

Products are subject to availability.

If an item becomes unavailable after you place your order, we may offer you:

an alternative item;
the option to wait for stock to become available; or
a refund for the unavailable item.

7. Personalised and Custom Products

Where we offer embroidery, monogramming or other personalisation, please check all information carefully before completing your order.

This includes names, spelling, sizing, colours and any other personalised details.

Once production or personalisation has begun, changes may not be possible.

Products made or personalised specifically according to your instructions cannot ordinarily be returned due to a change of mind.

This does not affect your rights where:

we have made an error in the personalisation;
the product is defective;
the product arrives damaged; or
the item differs materially from what you ordered.

8. Shipping and Delivery

Our Shipping & Delivery Policy forms part of these Terms.

Delivery dates and timeframes are estimates unless we expressly agree otherwise.

We will take reasonable steps to dispatch and deliver orders within the estimated timeframe, but delays may occasionally occur due to circumstances beyond our reasonable control.

9. International Orders

Catalina’s Linen may accept orders from selected countries outside South Africa.

International customers are responsible for ensuring that the products ordered may legally be imported into their destination country.

Unless otherwise expressly stated at checkout, customs duties, import taxes, clearance charges and similar fees imposed by the destination country are the responsibility of the customer.

International orders may be delayed by customs clearance or other processes beyond our control.

10. Returns and Refunds

Our Returns & Refund Policy forms part of these Terms.

Nothing in these Terms or our return policy is intended to remove or restrict statutory consumer rights that cannot legally be excluded.

11. Defective Products

Consumers may have statutory remedies where goods are defective, unsafe or fail to meet the quality standards required under applicable South African consumer law.

The Consumer Protection Act provides an implied warranty of quality in qualifying transactions and, within six months of delivery, may entitle a consumer to return qualifying defective goods for repair, replacement or refund.

These statutory rights are separate from our change-of-mind return policy.

12. Care Instructions

Customers are responsible for following the washing and care instructions supplied with their products or displayed on our website.

Damage resulting from misuse, inappropriate washing, excessive heat, bleach, ironing of waterproof materials, sharp objects, modification or ordinary wear and tear will not ordinarily constitute a manufacturing defect.

13. Nursery and Child Safety

Catalina’s Linen products should be used for their intended purpose and in accordance with applicable care and safety instructions.

Parents and caregivers remain responsible for ensuring that their child's sleep environment is suitable for the child's age and circumstances.

Decorative items appearing in photographs are not necessarily intended for use inside a baby's cot.

14. User Comments, Reviews, Feedback and Submissions

If you voluntarily send us a review, comment, testimonial, suggestion, idea, photograph, video, competition entry or other material, you remain responsible for the content you provide.

Where content is submitted to us for publication or promotional use, you grant Idea Groove (Pty) Ltd, trading as Catalina’s Linen, a non-exclusive, royalty-free licence to use, reproduce, display, publish, adapt and share that content for purposes reasonably connected with our business, including our website, social-media channels and marketing materials.

You retain ownership of your original content.

Where submitted material contains your name, image, likeness or other personal information, our use of that information remains subject to applicable privacy law and our Privacy Policy.

Where an identifiable child appears in a photograph or video, we may request specific permission from the child's parent or legal guardian before using that content for promotional purposes.

We are not obliged to:

publish a submission;
keep unsolicited ideas confidential;
respond to every submission; or
provide payment or compensation

unless we have separately agreed otherwise in writing.

We may decline, edit or remove content that we reasonably consider to be unlawful, misleading, defamatory, offensive, abusive, obscene, fraudulent, harmful or infringing of another person's rights.

By submitting content, you confirm that you own the content or have the necessary permission to provide it and that it does not infringe another person's intellectual property, privacy, personality or other rights.

15. Intellectual Property

The Catalina’s Linen name, branding, website design, photographs, illustrations, graphics, written content, product artwork and other intellectual property belonging to or licensed to us may not be copied, reproduced, distributed or commercially exploited without our written permission.

16. Website Use

You may not use our website:

for unlawful or fraudulent purposes;
to interfere with its operation or security;
to attempt unauthorised access to our systems;
to introduce malware or malicious code;
to impersonate another person; or
to infringe our rights or the rights of another party.

17. Third-Party Services and Links

Our website may use or link to services operated by third parties, including Shopify, payment providers, couriers, social-media platforms and other service providers.

Those services may operate according to their own terms and privacy policies.

18. Limitation of Liability

To the extent permitted by law, Catalina’s Linen will not be responsible for indirect, incidental or consequential losses arising from use of our website or products.

Nothing in these Terms excludes or limits liability or statutory consumer rights where such exclusion or limitation is prohibited by law.

19. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.

20. Changes to These Terms

We may update these Terms from time to time.

The version generally applicable to an order will be the version published on our website when the order is placed.

21. Governing Law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights that may apply to an international customer under the laws of their jurisdiction.
